商事证明认证案例
主题：
国际商事证明绝大部分是做形式性证明，即印章或签字的属实、影印件与原件的相符、中英文一致等。本文通过三个实质证明的案例从不同角度分析实质性证明对开拓认证领域、创新认证内容的重要性。
案例一：
证明事项：传真送达过程证明。
申请人：XXX，女，XXX律师事务所律师，律师执业证号：XXXXXXXXXX。
案情
了证明。证明也国际商会出证机构审查传真合法性的基础上，遵循严格的程序进行了证明。证词如下：
证明事项：传真送达过程证明。
申请人：XXX，女，XXX律师事务所律师，律师执业证号：XXXXXXXXXX。
申请人XXX律师为证明传真及所传送文件，根据"中国国际贸易促进委员会（中国国际商会）国际商事证明事务管理办法（试行）"规定，向我会提出申请。
申请人XXX律师于2007年7月24日下午来到我会，于我会办公室，在我会主任签证员XXX面前，使用我会传真机（0086 - 311 - 87832953），进行了如下操作：
1、 由XXX律师把将要发送的所附4页文件放入传真机。
2、 由XXX律师按下传真机免提键，在传真机上拨入001-972-7470377。
3、 根据传真机接通的提示音，由XXX律师按下"传真开始"键，开始传送。
4、 传真机发送4页文件完毕后，并由传真机打印出发送成功的报告。
兹证明：所附4页文件及发送成功后传真送达报告为XXX律师在本处主任签证员XXX面前现场操作过程中实时发送，操作过程与实际情况相符。
上述实质证明是很典型的关于行为过程的认证，从法律和程序上都可行，而如果仅从形式上认证印章或影印件，则肤浅的很。
案例二：
证明事项：公司经营能力与经营范围证明
申请人：河北某外贸公司
案情
申请人为新成立外贸企业，面临寻找客户和扩大企业营业额的问题。但由于竞争激烈，该公司知名度低，一段时间内并未得到外商认可，因此得到外商认可并扩大出口是该公司当时所面临的重要任务。为了证明自己的经营能力和经营范围，该公司特向国际商会申请证明。
证明过程
国际商会出证机构认真审查申请人所提供的营业执照等佐证文件，确认真实合法后，出具了证明文件，证词如下：
根据编号为XXXX的企业法人营业执照，河北XX贸易有限公司有权出口化工品：红丹、黄丹、醋酸铅、硝酸铅、三盐基硫酸铅、二盐基亚磷酸铅、硬脂酸铅、硬脂酸锌、硬脂酸钡，且该公司是河北国际商会的会员单位。

该公司向外商递交了上述中国国际商会出具的商事证明，外商很快对该公司产生了信任感。不久，该公司的定单有了较大增长。
案例三：
证明事项：装运货物船只的行驶和抵、离港状态证明
申请人：中国某进出口公司
案情
申请人在进口业务中，因外商延迟交货而导致国内最终用户提起索赔。因外商原因而使自己承担责任，申请人如不采取法律措施，将会面临很大损失。为了最大限度的为自己免责，申请人必须保存一些证据，因此申请国际商会对装运该批进口货物的船公司船只行驶和抵、离港状态进行证据保存。
证明过程
国际商会在情况属实的情况下，严格遵循程序规定出具了证明。证词如下：
本处签证员XXX与签证员XXX于２００６年６月２６日（17点）在河北省国际商会出证认证处使用本处计算机，通过宽带上网，对有关网页内容进行打印，具体操作过程如下：

上述证词描述了一个网上操作过程，从法律上对网络证据进行了保存和认证，这种网络证据保存从操作上做并不复杂，且对国际商会开拓认证内容具有示范作用。
案例评析
通过阐述上述三个案例，笔者认为，国际商事证明在未来有很大的发展空间，尤其是实质证明的开拓潜力是很大的。在相对于“公证”、“律师见证”等司法证明体系中，国际商事证明在商业领域、民事领域具备一定的生存和发展空间。随着国际交往的不断扩大，国际商会的知名度和作用的不断提高，国际商事证明必将迎来一个发展的新阶段。
